PROCLAMATION

by

HIS EXCELLENCY THE HONOURABLE EMMERSON DAMBUDZO MNANGAGWA, G.C.Z.M., President of the Republic of Zimbabwe and Commander-in-Chief of the Defence Forces of Zimbabwe.

 

WHEREAS, by section 143(1) of the Constitution, Parliament is elected for a 5 year term which runs from the date on which the President-elect is sworn in and assumes office in terms of section 94(1 )(a) of the Constitution;

AND WHEREAS, after the last election, the President was sworn in on the 22nd day of August 2013, and the live year period ends on the 21st day of August, 2018;

AND WHEREAS it is provided by section 144(1) of the Constitution that where Parliament has not earlier passed resolutions to dissolve in terms of section 143(2), the President must by proclamation call and set dates for a general election to be held within a period prescribed in section 158;

AND WHEREAS, in terms of section 158(I)(a) of the Constitution, a general election must be held .so that polling takes place not more than thirty days before the expiry of the five year period specified in section 143;

AND WHIEREAS it is provided by seetion38of the Electoral Act [Chapter 2:13] that in a proclamation fixing dates for the holding of an election to the office of President, a general election and elections for councillors, the President, after consultation with the Commission shall provide for the matters required by the said section 38;

AND WHEREAS it is provided by section 38 as read with section 45C of the Electoral Act [Chapter 2:13] that the nomination of party list candidates for the Senate, the National Assembly and provincial councils shall take place on the same day and venue as the nomination for the constituency National. Assembly candidates;

AND WHEREAS the Zimbabwe Electoral Commission, having advised that it has not conducted any delimitation of the electoral boundaries as provided by section 161(1) of the Constitution, the boundaries of provinces, constituencies and wards existing at the last election, shall apply for the purposes of this election:

NOW, THEREFORE, under and by virtue of the powers vested in the President as afore said, 1 do, by this proclamation—

....

(a)        fix Monday, the 30th day of July, 2018, as the day of the election to the office of President, the election of members of the National Assembly and election of councillors, that is to say, as the day on which a poll shall be taken if a poll becomes necessary in terms of section 46( 17)

(c)         or 125(4)(b) of the Electoral Act [Chapter 2:13] for the election to the office of President or any such members of the National Assembly or councillors; and

(b)       fix Saturday the 8th day of September, 2018, as the day of the runoff election to the office of President, that is to say as the day on which a poll shall be taken if such a poll becomes necessary in terms of section 110(3)(f) (iii) of the Electoral Act [Chapter 2:13]
